The Fair Debt Collection Practices Act is a federal law designed to protect consumers and regulate the practices of debt collectors. It outlines the actions debt collectors can take when collecting debts and sets the rules for interactions between them and consumers. Unfortunately, not all debt collectors abide by the FDCPA, which leads to creditor harassment, complaints to the Federal Trade Commission and even lawsuits. If you believe that you are suffering from creditor harassment, Strong Law Group can help.
Creditor Harassment and the FDCPA
When you’re dealing with abusive creditors, you might feel as if you are alone. However, the law is on your side. The Federal Trade Commission has taken action against numerous collection agencies for violations of the FDCPA and will enforce the law.
Examples of FDCPA violations include:
- Calling you early in the morning or late at night
- Calling you without identifying themselves as debt collectors
- Calling you at work even though they have been told your employer will not allow it
- Using abusive, obscene or profane language
- Lying about the debt or threatening to use violence
- Threatening to imprison you or to seize your property
- Adding unauthorized fees, charges or interest
- Continuing to contact you after you have requested them in writing to stop
The law only protects consumers and consumer debts, such as credit card debts, medical bills, mortgages and student loans. It does not apply to non-consumer debts, such as tax debts, domestic support obligations, business debts or legal fees.
The FDCPA is a federal law, and each state may offer further protection to consumers. Having an experienced attorney on your side can help you better understand your rights and protect you from abusive debt collectors and creditors.
